1. Acceptance of Terms

By accessing or using Artificial Identity ("Service") at artificial-identity.com, provided by NEXT DECADE, a SAS (société par actions simplifiée) registered under RCS Paris B 907 825 012 in Paris, FRANCE, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Artificial Identity is an AI-powered photo generation platform that allows users to create and manage AI-generated images. Key features include:

• Training custom AI models with your own photos
• Using pre-defined prompts to generate photos
• Creating custom prompts for photo generation
• Managing and downloading generated photos in your library
• Purchasing credits for model training and photo generation

3. Credits and Billing

The Service operates on a credit-based system:

• New users receive 20 complimentary credits upon account creation
• Additional credits can be purchased through our payment processor, Polar
• Credits are required for model training and photo generation
• Purchased credits are non-refundable

4. Intellectual Property and Generated Content

Intellectual property rights are distributed as follows:

• The Service platform and its original features are owned by NEXT DECADE
• The underlying AI model (Flux) is developed by Black Forest Labs (blackforestlabs.ai) and provided through fal.ai
• Generated photos belong to the user who created them
• NEXT DECADE disclaims responsibility for any intellectual property issues arising from content generated through the Flux model

5. User Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws
• Take responsibility for the content you generate using the Service
• Ensure you have necessary rights to any photos used for model training
• Not attempt to circumvent any Service limitations or restrictions

6. Limitation of Liability

NEXT DECADE shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the Service.

7. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

9. Service Limitations

As our Service continues to evolve, please be aware of the following limitations:

• Users may be subject to usage limits, generation restrictions, or other limitations
• We reserve the right to modify the features available in the Service at any time
• We may introduce new generative models or remove existing ones, with notice provided for significant changes
• The Service may experience downtime, bugs, or other issues typical of evolving software

10. Data Security and Confidentiality

We implement industry-standard security measures to protect your data and uploaded files. Our employees do not access your files except for maintenance purposes or when explicitly requested by you. We maintain regular backups and have disaster recovery procedures in place to ensure the safety and availability of your data.

11. User Content Rights and Ownership

You retain all rights and ownership of your generated content and uploaded files. NEXT DECADE does not claim any ownership rights to your content and will not use, modify, or distribute your assets without your explicit permission. You are solely responsible for ensuring that you have the necessary rights to create, upload, and store your content on our platform.

12. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through the following process:

• Informal Resolution: We encourage users to contact us first with any concerns
• Mediation: If informal resolution is unsuccessful, parties agree to engage in mediation in Paris, France
• Litigation: If mediation fails, any legal action shall be brought exclusively in the courts of Paris, France

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
